1. Who we are

Sooper is a brand of TMJ Group ApS, a private limited company registered in Denmark. getsooper.com is run by TMJ Group ApS.

In these terms, "Sooper", "we", and "us" mean TMJ Group ApS, and "you" means the person using the site or buying from it.

2. What these terms cover

These terms apply to every order placed on getsooper.com and to your use of the site. We sell to consumers, meaning people buying for their own personal use. If you're buying for a business, email us before you order.

Nothing in these terms takes away any right you have under the consumer law of the country where you live. Where these terms and that law differ, the law wins.

Our Privacy policy, Shipping policy, and Returns and withdrawal policy also form part of your agreement with us. Giveaways and promotions have their own terms, published with each one.

3. Your account

You can check out as a guest or create an account. If you create one, give us accurate details and keep your password to yourself. You're responsible for orders placed through your account. We can suspend an account that's used in breach of these terms, and we'll tell you why.

4. Products and prices

We show our products as accurately as we can. Colours on screen depend on your device, so the real thing can look slightly different. Measurements in our size guides are approximate and can vary by 1 to 2 cm.

All prices are in euro and include VAT at the rate that applies in your country. Delivery costs are shown separately at checkout before you pay. We can change prices at any time, but the price you pay is the price shown when you place your order.

Some products are sold in packs or bundles, for example a 3-pack of tees, at a lower price per item. If you return part of a bundle, we refund the price per item you actually paid.

Products are available while stock lasts. If an item sells out after you've ordered, we'll tell you straight away and refund what you paid for it.

5. How an order works

Our product pages are an invitation to order, not a binding offer. The ordering process works like this:

  1. Choose your products, sizes, and quantities, and add them to your cart.
  2. Go to checkout and enter your email, delivery address, and payment details.
  3. Review your order on the final checkout page. You can correct any mistake by going back a step or editing your cart.
  4. Click the final button to place your order. This is a binding order with an obligation to pay.

The contract between you and us is formed when we send your order confirmation email, which happens right after you place your order. That email lists what you ordered, the total price, and a link to these terms.

We store the details of your order. You can see them in your confirmation email and, if you have an account, in your order history. These terms are always available on this page, and you can download or print them from your browser. Contracts are concluded in English.

6. Payment

We accept the payment methods shown at checkout. Payments are processed by Shopify Payments and the other providers shown at checkout. We never see or store your full card details.

Your payment is taken when you place your order. If a payment provider declines your payment, no contract is formed and we won't ship your order.

7. Delivery

We deliver to the countries available at checkout. Delivery time and cost for your address are shown at checkout before you pay. If we can't meet the delivery estimate we gave you, we'll tell you and give you a new one. If we can't deliver within 30 days of your order, you can cancel and get a full refund.

The goods are your responsibility once they're delivered to you or to someone you named to receive them. If a parcel arrives damaged or something is missing, email us with your order number and, if you can, a photo. This helps us fix it with the carrier and doesn't affect your legal rights.

8. Your right to withdraw (14 days)

You can withdraw from your order within 14 days without giving a reason. The 14 days start on the day you, or someone you name (other than the carrier), receive the goods. If your order arrives in more than one parcel, the 14 days start when the last parcel arrives.

To withdraw, use the "Withdraw from contract" link. You'll find it in the footer of every page, on every product page, and in your order confirmation email, and you don't need to log in to use it. You can also send a clear statement by email to hello@sooper.com or by post to TMJ Group ApS, Skovvejen 25, 8000 Aarhus C, Denmark. You can use the model form at the end of these terms, but you don't have to. It's enough to send your statement before the 14 days are up.

When you withdraw, we refund everything you paid, including standard delivery. If you chose a faster delivery option, we only refund the cost of standard delivery. We refund within 14 days of receiving your withdrawal, using the same payment method you used, at no extra cost to you. We can hold the refund until we've received the goods back or you've shown us proof that you've sent them, whichever comes first.

Socks delivered in sealed packaging can't be returned once the seal is opened, for hygiene reasons.

9. Sending items back

  1. Send the goods to the return address we give you when you withdraw, within 14 days of telling us. The deadline is met if you post them before the 14 days are up.
  2. You can try items on the way you would in a shop. If an item has been worn beyond that, washed, or had its tags removed, we can reduce your refund by the loss in value.
  3. You pay the cost of sending items back.
  4. Pack items securely and include your order number so we can match your return to your order.

10. Exchanges

We don't do direct exchanges. If you need a different size or colour, withdraw from the order for the item you have and place a new order for the one you want.

11. Faulty items (legal guarantee)

You have a 2-year legal guarantee from the date of delivery. If an item is faulty or not as described, email us with your order number, a short description, and a photo. We'll repair or replace it, or if that isn't possible within a reasonable time, give you a partial or full refund. We cover the cost of sending faulty items back.

Normal wear, damage from misuse, and damage from not following the care label are not faults. We don't offer a separate commercial guarantee on top of your legal rights.

12. Discount codes and store credit

Unless a code says otherwise, you can use one discount code per order. Codes have no cash value, can't be transferred or sold, and can't be applied to an order after it's placed. Each code shows its expiry date and any minimum spend.

If you sign up to our emails, you can earn credit back on your first order. We send the code by email after the 14-day withdrawal period for that order ends, with its value and expiry date stated in that email. If you withdraw from your whole first order, no code is issued.

13. Giveaways and promotions

Giveaways and promotions have their own terms, which we publish with each one and which apply alongside these. No purchase is needed to enter a giveaway. Where a promotion's own terms differ from these, the promotion's terms apply to that promotion.

14. Free training and nutrition content

The Everyday Athlete program, nutrition targets, and tracking sheet are free general information. They aren't medical advice and aren't tailored to your health. Check with a doctor before starting, especially if you have an injury, a health condition, or haven't trained in a while. Stop and get advice if anything hurts. Results depend on the person and aren't guaranteed.

You can use this content for your own training. You can't sell it, republish it, or pass it off as your own.

15. Our content and brand

The text, photos, videos, designs, logos, and product and fabric names on this site belong to us or to the people who license them to us. You can view and share our pages for personal use. You can't copy or use our content for any commercial purpose without our written permission.

16. Reviews and content you share

If you post a review, photo, or comment on our site or tag us on social media, it must be honest, your own, and lawful. You give us a free, non-exclusive right to show it on our site, in emails, and on our social channels, with your first name or handle. We'll ask before using it in paid ads.

We publish positive and negative reviews. We only remove reviews that are unlawful, offensive, or unrelated to the product. Reviews marked as verified come from customers whose purchase we've confirmed against our order records.

17. Using the site fairly

Don't use the site in a way that breaks the law, harms the site or other users, or tries to get around our security. This includes using bots or scripts to place orders or collect data. We can block access for anyone who does.

18. Our liability

We're fully liable for damage we cause on purpose or through gross negligence, for injury to life, body, or health, under product liability law, and under any guarantee we've given.

For damage caused by slight negligence, we're only liable if we breach an obligation that's essential to the contract and that you're entitled to rely on. In that case our liability is limited to the damage that's typical and foreseeable for this kind of contract.

This section doesn't limit your legal guarantee rights in section 11. We work to keep the site running, but we can't promise it will always be available or free of errors.

19. Privacy

Our Privacy policy explains what personal data we collect, why, and what rights you have. We only send marketing emails if you've agreed to them, and you can unsubscribe at any time.

20. Changes to these terms

We may update these terms from time to time. The date at the top shows the latest version. The terms that apply to your order are the ones published when you placed it.

21. Law and disputes

These terms are governed by Danish law. If you live in another EU country, you also keep the protection of the mandatory consumer law of that country, and you can bring a claim in the courts where you live.

If something goes wrong, email us first and we'll try to sort it out. If we can't agree, you can complain to the Danish Consumer Complaints Board through the Centre for Complaint Resolution, Nævnenes Hus, Toldboden 2, 8800 Viborg, Denmark, at www.forbrug.dk. If you live in another EU country, you can also contact the European Consumer Centre Denmark at www.forbrugereuropa.dk.
